Understanding the AML Landscape in the United States

Anti-Money Laundering (AML) compliance is a cornerstone of financial integrity and national security in the United States. While traditionally focused on banks, credit unions, and broker-dealers, the scope of AML regulations has expanded significantly to include a broader range of entities, such as money services businesses (MSBs), casinos, and even certain digital asset service providers. Non-compliance can lead to severe civil and criminal penalties, including substantial fines, imprisonment, and reputational damage, making a robust AML program an essential component of any U.S. business's operational strategy.

Core Components of an Effective AML Program

FinCEN regulations generally require covered financial institutions to establish and maintain an AML program with at least five core pillars. While the specific implementation will vary based on the size, complexity, and risk profile of the business, these fundamental components are universally applicable and critical for effective compliance.

1. Internal Controls and Policies

This pillar involves developing and implementing internal policies, procedures, and controls designed to ensure ongoing compliance with the BSA and its implementing regulations.
