The Employment Ordinance: The Cornerstone of Hong Kong Labour Law

The primary legislation governing employment relations in Hong Kong is the Employment Ordinance (Cap. 57, Laws of Hong Kong). This ordinance sets out the minimum statutory requirements for employment contracts, wages, working hours, rest days, holidays, annual leave, sickness allowance, maternity leave, paternity leave, termination of employment, and other related matters. It applies to almost all employees, regardless of their nationality or the type of work they perform, with a few limited exceptions (e.g., certain family members working in the same household). Employers must be acutely aware that any contractual terms that are less favourable than those stipulated in the Employment Ordinance are null and void to the extent of the discrepancy. Therefore, all employment contracts and company policies must at least meet, if not exceed, these minimum standards.

Key Provisions and Employer Obligations

Employment Contracts: While not strictly mandatory for all employment relationships to be in writing, it is highly advisable to have a clear, written employment contract for every employee. This document should detail key terms such as job title, duties, commencement date, working hours, remuneration, benefits, probationary period, notice period for termination, and any special conditions. A well-drafted contract can prevent disputes and provide clarity for both parties.

Wages and Remuneration: Hong Kong has a Statutory Minimum Wage (SMW) that is reviewed periodically. Employers must ensure that all employees are paid at least the SMW. Wages must be paid at least once a month, within seven days after the end of the wage period. Deductions from wages are strictly regulated and generally only permitted for specific reasons, such as overpayment, damage to company property (with strict limits), or contributions to retirement schemes.

Working Hours, Rest Days, and Holidays: The Employment Ordinance does not prescribe maximum working hours for all employees, though certain industries may have specific regulations. However, it mandates that employees are entitled to at least one rest day in every period of seven days.
