The Tax Refund System

The full imputation system is operationalised through a sophisticated tax refund mechanism. When a company distributes dividends from profits that have been taxed at the 35% corporate rate, the shareholders (whether corporate or individual, resident or non-resident) are generally entitled to claim a refund of a portion of the tax paid by the company. The most common refund is a 6/7ths refund of the Malta tax paid by the company on its active income. This effectively reduces the overall effective tax rate for the shareholder to 5% (35% - (6/7ths of 35%) = 5%).

Other refund rates apply depending on the nature of the income:

  • 5/7ths Refund: Applicable to passive interest and royalties. This results in an effective tax rate of 10%.
  • 2/3rds Refund: Applicable when the distributed profits have benefited from double taxation relief. The refund is calculated on the Malta tax paid after relief.
  • 100% Refund: Available in specific circumstances, primarily where profits are derived from a participating holding and certain conditions are met (as discussed below).

It is crucial to note that these refunds are granted to the shareholder upon the distribution of dividends. The refund process typically involves filing a specific claim with the Maltese tax authorities, and the refunds are usually processed within a reasonable timeframe, often within 14 days of the claim being filed, provided all documentation is in order.
