Panama has long been recognized as a strategic hub for international business due to its advantageous geographic location, stable economy, and flexible corporate laws. However, in recent years, the country has also been under intense international scrutiny regarding its efforts to combat money laundering and terrorist financing. This has led to a significant overhaul and strengthening of its Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF) framework. For any company operating in or through Panama, understanding and meticulously adhering to these regulations is not merely a legal obligation but a critical component of sustainable business practice and reputational protection.

The Evolving AML Landscape in Panama

Panama's commitment to enhancing its AML/CTF regime has been driven by recommendations from international bodies such as the Financial Action Task Force (FATF) and the Latin American Financial Action Task Force (GAFILAT). Historically, Panama faced challenges related to transparency and beneficial ownership. In response, the government has enacted several key pieces of legislation and regulations aimed at bringing its framework in line with global best practices. The primary legal instruments governing AML in Panama include Law 23 of 2015, which established a comprehensive system for the prevention of money laundering, terrorist financing, and the financing of the proliferation of weapons of mass destruction, and subsequent decrees and resolutions that refine and expand these requirements. Additionally, Law 52 of 2016 mandates the maintenance of accounting records for all legal entities, and Law 124 of 2020 created the Superintendency of Non-Financial Subjects, extending AML oversight to a broader range of businesses.

These legislative changes have significantly broadened the scope of regulated entities beyond traditional financial institutions to include a wide array of non-financial businesses and professions (DNFBPs). This includes, but is not limited to, real estate agents, lawyers, accountants, trust and company service providers, precious metals and stone dealers, and even certain types of non-governmental organizations. The overarching goal is to enhance transparency, identify beneficial owners, and prevent the misuse of Panamanian legal entities for illicit financial activities.

Key Regulatory Bodies and Their Roles

Several governmental bodies are responsible for the oversight and enforcement of AML regulations in Panama:

  • Financial Analysis Unit (UAF): This is Panama's Financial Intelligence Unit (FIU), responsible for receiving, analyzing, and disseminating suspicious transaction reports (STRs) to law enforcement agencies.
